Let's Talk ARD: Part 2- Requirements

So, you want to get into the ARD program?

First of all, let's back up, for those of you who don't know what the ARD program is. It's the Alternative Rehabilitative Disposition program. A program which essentially functions as an alternative to a lengthy trial process, a conviction, and a possible mandatory jail sentence. It's a program appreciated by PA DUI lawyers and coveted by DUI offenders.

The ARD program requires the DUI offender to successfully complete it; at the end of which the charges are dismissed and the offender's record may be expunged after a period of time. Of course, this is pending certain conditions.

We've already discussed who can get into the ARD program. Now, let's talk about the program itself, and what you and your PA DUI attorney need to do if you want in. Here is a list of requirements from Lancaster County. Although the processes differ from county to county, this should give you a broad guideline on what to expect.

Within 30 days after the filing of a criminal complaint, you must waive the preliminary hearing and complete the ARD application. You must submit that application, along with a copy of the criminal complaint, and an affidavit to the District Attorney's Office.

In that time period, you must also sign a continuance form with the DA's office and schedule a Court Reporting Network (CRN) evaluation with the Office of Probation and Parole. You need to call the D.A.'s office in order to set that evaluation up. Within the 30 day period, you will also need to call Community Resources.

You need to complete this assessment within six months of the date of filing of the criminal complaint. You must also schedule any necessary and required Drug and Alcohol treatment under a licensed program. Alcohol and Highway Safety School must be completed within six months of the criminal complaint.

The fee of $600 must be paid during that period.

Once those requirements are met, the offender may be admitted to ARD.

During admission to the ARD program, you will be under supervision for twelve months. You must then complete the Alcohol and Drug treatment and pay the rest of the money you owe (fines, restitution, costs, fees, etc).
