And that's what Matthew C. Lynch's Pa DUI lawyer is trying to do. Matthew Lynch's trial began earlier this week, for the alleged DUI homicide of Isaiah Washington of Philadelphia.
Isaiah Washington was 20 years old at the time. He was a front seat passenger in Matthew Lynch's car.
Matthew Lynch had been behind the wheel when his vehicle went airborne and hit a tree.
While a typical criminal case involves a jury, the trial of Matthew Lynch is before a judge, with no jury. As such, his Pa DUI lawyer has the burden of proving a lack of direct fault linking the DUI with the death of Isaiah Washington.
In attempting to prove so, Lynch's Pennsylvania DUI attorney cross examined a passenger from that vehicle, trying to show that the accident may have been caused by horseplay by the victim and the driver as opposed to the DUI.
Earlier this year, the Pennsylvania DUI attorney for Thomas Senavitis got his client acquitted for vehicular manslaughter when he convinced the jury that the accident was the result of the victim swerving into the wrong lane in order to avoid a parked car.
Pa DUI attorneys have a multitude of tricks and techniques up their sleeves. A good Pennsylvania DUI attorney should be able to prepare a solid defense in the event their client is facing DUI homicide charges.
While this is a sad case, it may not necessarily be the driver's fault.
