PA DUI lawyers are buzzing about the latest DUI case from New York.
According to People, the newest Real Housewives of New York City star, Sonja Morgan was charged with a DUI in Southampton, N.Y.
Sonja Morgan, who is the ex-wife of John Morgan (heir to the J.P. Morgan fortune), apparently whizzed by a stop sign at approximately 2:16 a.m. and was immediately pulled over. After failing field sobriety tests, and refusing to take a Breathalyzer test, Sonja Morgan was charged with a DUI. Her court date for the charge is not yet known.
When asked to comment, a representative from Bravo said: "Sonja cannot comment as it is a legal matter."
While this is a New York DUI charge, it is important for Pa DUI lawyers to stress the importance of explaining what probable cause for a DUI arrest is.
In this case, the officer has a reasonable belief that Sonja Morgan had committed or was about to commit the crime of driving under the influence. This reasonable belief would stem from the facts surrounding the case. In this instance, the failed field sobriety tests coupled with Sonja Morgan's erratic driving may have given the officer reason to believe that she was driving under the influence in spite of the fact that there was no Breathalyzer test.
Arrest with probable cause means that while there are strong indicators of a DUI, results of a chemical test are not available because of driver refusal or other circumstances.
If a PA resident is charged with a DUI but refuses a chemical test, that resident can be penalized for that refusal based on implied consent laws. However, with a clever Pennsylvania DUI attorney, a possible DUI charge could be dropped.
